Criminal Defence in the Western Cape: Courts, Rights and What to Do

The Western Cape is served by a network of Magistrates' Courts, Regional Courts and the Western Cape Division of the High Court in Cape Town. Whether a matter arises in Cape Town, Stellenbosch, Paarl, George or elsewhere in the province, the process governed by the Criminal Procedure Act 51 of 1977 applies.

Western Cape criminal courts

The Western Cape has Magistrates' Courts in Cape Town and across the province, including Bellville, Wynberg, Mitchells Plain, Stellenbosch, Paarl, Worcester, George, Knysna and Mossel Bay, among others. Most criminal matters begin in the Magistrates' Court for the area where the arrest occurred.

The Western Cape Regional Court in Cape Town handles more serious offences. The most serious matters are referred to the Western Cape Division of the High Court, which sits in Cape Town.

Your rights when arrested in the Western Cape

Section 35 of the Constitution applies throughout South Africa, including across the Western Cape. These rights arise from the moment of arrest.

  • The right to remain silent.
  • The right to be told why you have been arrested.
  • The right to consult with an attorney of your choice.
  • The right to be brought before a court within 48 hours.
  • The right to be presumed innocent until proven guilty.

The first court appearance in the Western Cape

After arrest anywhere in the Western Cape, the accused must appear in a Magistrates' Court within 48 hours. The first appearance deals with the formal charge, bail, and the first postponement of the matter.

Bail is determined under the Criminal Procedure Act 51 of 1977. The schedule of the offence determines the applicable bail test. Early legal representation before the first court date gives the best chance of a well-prepared bail application.

The Western Cape Division of the High Court

The Western Cape Division of the High Court sits in Cape Town. It hears the most serious criminal matters in the province, including appeals from the Magistrates' Courts and Regional Court, and bail review applications.

Cases are assigned to this court based on the area where the offence occurred or where the accused is detained.
