Why unmarried couples need a cohabitation agreement
South African law has no common law marriage. No matter how long you live together, you do not automatically gain the rights that married couples have. Under the Intestate Succession Act 81 of 1987, an unmarried partner does not automatically inherit if their partner dies without a will. South African courts have recognised cohabitation and life partnership agreements as enforceable contracts, but without one in writing you have no guaranteed claim to shared property and no automatic right to inherit. Paired with a will, a life partnership agreement gives you both the clearest possible protection under South African law.
The Matrimonial Property Act 88 of 1984 does not apply to unmarried couples — your financial relationship is governed entirely by what you have agreed in writing. Without a cohabitation agreement, disputes about shared property can be lengthy, expensive and emotionally draining.
