Registration at the Deeds Office takes approximately 7 to 10 working days. Delivery of the registered contract typically takes 1 to 3 months, depending on Deeds Office processes. You can collect your contract at our office or arrange courier delivery at your cost. We can also store it securely until you are ready to collect.

The three matrimonial property regimes in South Africa
Under the Matrimonial Property Act 88 of 1984, South African law recognises three matrimonial property systems. Your antenuptial contract determines which one applies to your marriage.
1. In community of property (the default)
If you marry without an antenuptial contract, you are automatically married in community of property. All assets and liabilities — including each other's debts — are merged into one joint estate shared equally between the spouses. Either spouse can bind the joint estate for large transactions, which creates financial risk. This system offers no financial independence.
2. Out of community of property — without accrual
Each spouse's estate remains entirely separate, both during the marriage and if it ends. You keep what is in your own name and you are not responsible for your spouse's debts. On divorce or death there is no sharing of growth — each party walks away with their own estate. This is the strictest form of financial separation and suits couples who want complete independence.
3. Out of community of property — with accrual

The accrual is the net increase in each estate from the start of the marriage.
